The guys a joke...wonder why he stops at "Consider a typical Anchor Immigrant who comes from a developing nation and has three adult siblings" he should say typical anchor immigrants have 15 siblings and anchor immigrant gets a GC and USCIS presents the entire clan with GCs on the spot... I really dont know,why did you sign a contract , when you were paying for the H1B transfer.
I was in such a contract when i came to the US, and i left the company when i wanted to.These types of contracts don't hold in the court of law (How can they say that the white collar slavery is legal).The only thing which holds is the Non Compete Clause (If you join the Client Directly, in case of a consultancy firm)...
I do not know the exact wording of your contract , and i am not a lawyer.These are my personal views, and do not constitute a legal advice.

It looks like you can show some light on my stuggle with ICICI bank to deposit money in My ICICI NRE account.
Story is like this, I went to India this summer deposited money to several mutual funds from my ICICI NRe account. One of the investment (in franklin ) was wrong by the mistake of my agent ( because US person can not invest in some of the US based mututal funds and frankln is US based fund) So I had to struggle to get money back from Franklin, as it was not proper investment ( wer mentioned NRE US based in forms, so they should have out right rejected investment, but they alloted it and then I have to fght back to get it returned)
Luckly due to my correct application I was able to get money back from franklin. they issued RS check, which I tried to deposit to my NRE account at ICICI bank. ICICI rejected check saying it is in RS. I tried to persue them it is REFUND FROM MUTUAL FUND (NRE INVESTMENT) from the same ICICI account but they still wants the proof that it NRE money. I have still this check bouncing back between me and ICCI bank. I also approached franklin to get letter. This time they have qouted some earlier RBI rule ( I have not read letter) and I am trying to redeposit that with check again.
Here in this My bigger question is we all are investing lot of Money from NRE account in Mutual funds and other investment options available to US in India as NRI. but when it comes to getting money back in our NRE account ( naturally all returns/refunds from India investment will be in RUPEES CHECKS ONLY) then we have big trouble like One I am facing right now.
SO DOES OUR INVESTMENT IS TRUELY REPRETRIABLE.
WE CAN GET OUR ORIGINAL INVESTMENT AS WELL AS GAINS ON THAT BACK TO NRE ACCOUNT OR NOT
IS IT THE ICICI BANK ONLY or ALL OTHER BANKS ARE GIVING TROUBLE wHEN WE TRY TO REDEPOSIT OUR MONEY ( in rupees) back to our NRE account.
Please explain your experiences in this regard.

ICICI sucks......i hate those guys.....their claims are big but poor banking and customer service......personally i have found SBI to be best although they are little slow.
On the top of it....sending money for investment is a bad idea......I have already lost money in it....and now facing issues getting money back.
In the whole episode, I lost so much peace of mind that money that grew in India was not worth........I guess there is a limit to what we want but greed inside us still ask us to invest.....let it be hard way....but I have learnt a lesson....if I have to live in US....it is better that I find investment opportunities here and live a "peaceful life". At the end we all need peace !!!

Agreed it's frustrating to go thru a roller-coaster ride as far as GC is concerned. I believe members of IV are leaving no stone unturned to tide over the GC hurdles by speaking in one voice and acting in unison.
Literally, we must have the 'staying power' to do this. If people wanna go back to their home country, it's their personal decision. Impatience and frustration should not be the driving factor for people to return to their home country.

Health Care professionals have greater lobby power and resource and are backed by their Industry as well. Well, this does not translate directly into any benefit for EB3, but might help few nurse get off the queue. But demand in this sector is also high.
General EB3 !!! seems to be in a pathetic state at least based on today's public data available !!

You have to register the birth with the consulate (to get an Indian birth certificate) within a year using this form (see part II) (http://www.cgisf.org/visa/misc.pdf), following which you should be able to get an Indian passport. The USA will not issue a visa on this passport since it considers the child to be a US citizen. However, US policy in this regard does not matter if the child never travels to the US.

as far as I know, you paying for H1b is not correct and is illegal and they will be accountable for this. Secondly, I heard the contract dont stand in court, especially when they are rude.
I think you have an option to report this employer to DOL/USCIS, for charging you the H1b expense. Companies should sponser H1b only when they genuinely need and can pay for the expense!
I am not a lawyer, so I recommend you consult one. Also feel free to communicate this issue to your employer and I guess you will be on your own!

Robbers charging your credit card is no big deal either. There are federal laws protecting us on incorrect credit card charges. Would you want to risk your life for just $50?
Year ago, my credit card was used by someone in Vegas and they charged about $2000.....I didn't loose my card and I was no where near Vegas during that time. My bank didn't charge me even a penny after going thru the identity theft complaint process which involved sending couple of mails with some notarized stuff and few phone calls.
Last month, my wife's handbag (had card in it) was pick-pocketed in a small town in India and they tried to use the card. We were on vacation and immediately called the bank and canceled the card.
Point is, whether it is India or US or anywhere, if a thief gets hold of your card, they would try to use it. For some, there is nothing like a free lunch!
Another example my ex-boss in US had. There was a homeless person in his area and he used to see him almost every day. One day he decided to do something, talked to him and asked him to sign-up with his church rehab group, get him a job etc....My ex-boss was serious but the homeless promptly rejected all the offers and instead he just wanted to remain as homeless only. He didn't even want to try....

Its illegal for an employer to charge for H1B. You cannot expect employee to know and enforce the law. Employers know its illegal to charge money and in this case his employer is in violation of law.
I wasn't moral policing, I was just laying out the legal stand that anybody can have under these circumstances. I am sure that the so called "Desi shop owner" is not so dumb to so flagrantly violate the law when his employee is going by the book, unless the employee is seriously gullible.

Thanks nrk. I am keeping my fingers crossed. I was current for two months in 2008 but did not get. So hoping for the best this time but again I would not be surprised if I don't get it, especially looking at USCIS/DOS works.

This looks pretty authentic. It wouldn't make any sense for a lawyer to fake this unless someone hacked their website. There is a good possibility that the date is May 08, 2006 for EB2 I / C
