    Hello Pappu,

    Fantsatic news. I think we have to unite for this big event - this is the BEST time to get our voice heard. If illegal immigrants are voicing why not We? Most of us are here for atleast close to TEN years and contributed for this economy. PERIOD.

    You can not ignore some one just because they have a different opinion, and YES I do have the exact same interest as all of you on the forum. There are many ways to slide and dice an issue and this is just my take on it. I am not trying to turn this into a ugly thread but just voicing my concerns, so no offense to any one.

    I asked my attorney he said that I need to wait at least 1 more year. The Nov and Dec are gone in holidays. These Gov emp are worst then Indian Gov Emp.

    Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
    We need to stand united and raise awareness and sign up for the $20minimum a month recurring contribution.

    I understand that some of you do intend to contribute and have contributed generously in the past,
    But here are some mindsets, All of us fall in these 4 mindsets.

    1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
    2) I have contributed enough.
    3) I will contribute if I feel like, when I see something comming out of this effort.
    4) I do not have to contribute.

    If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can plan better.

    Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.

    Category 3) This has been discussed, I do not want to talk about this category of members.

    Category 4) Again - No Comments-

    Lets show the core team that all of us fall in the first 2 categories.

    The last thing we want the core to do is bite their fingers over funds. We do not want the core to get stressed out over funds. They have enough real work to do already.

    I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. May be you were not aware that this organisation and the lobby money has come out of pockets of ordinary hard working people like you. But this is our last chance. WHAT ARE YOU WAITING FOR?.

    Hey Guys,

    This EAD thing is really annoying, my wife got her AP and EAD last 11/21, with immediate update in USCIS.gov. I'm still waiting for mine, and I'm the principal. Anyway. I'll have an infopass appointment on 12/18. My H1-B permit expires on 02/07/08.

    We applied to NSC, all documents received on August 02/2007.
    My RD at NSC was 07/02/07 and my EAD status changed to "production ordered" just 5 days back(still dont know when I will get it). I think NSC is taking upto 5 months from RD to process the EADs.

    Firstly I am not from India where most of your guys come from. Instead from Taiwan 2 and half year ago. As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Just kill the time???

    When cops knock out your room, handcuff your hands on the back, force you stay down at the corner , if you could keep calm and state very clearly. I can only show my respect but unfortunately I did not make it. This is my first time. :( Should be the last time either.

    Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. I knew you all have better english than me. so you could explain clearly :) But Same level, do it on your spouse is even worse on a stranger.

    I create this thread just wish listen your opinion and try public view how much chance I can win the jury trail. Some of your advice is really helpful and I will take them.

    My wife is writing the mail to DA and wish it helpful to my case. I will have several rehearsal with my attorney in coming weeks. Anyway, we will fight for the justice and not accept that ridiculous battery charge.

    No need to upset. This is a different type of question. I googled and researched on it for hours, how to suggest you. In fact I did not know several words and acronyms used here.

    This is a situation because of cross-cultural differences, ignorence of law of land, weaker knowledge of English, etc. It might not have been aggrivated, had you been in your native country.

    Once in Japan, I crossed rails to go to next platform and caught by police for doing so. I explained them my childhood, when every day I used to do so in small town and it was OK there. Police told me that they understand me, and asked me not to repeat again there.

    My son asked for Samurai. On airport, the moment police saw it, they snatched it from me. They kept it under their possession and handed over to airlines to give me back at destination.

    I feel that police and people are considerate to situation.

    So, based on my experience of sevaral such things happening due to ignorance and past habits:
    .... Use translater and explain in native language (You can say that you know technical language to work in office, but don't know day-to-day language. You don't know difference between drag, pull, take along, etc).
    .... If you have any cultural example, explaining up to what level it is acceptable in your society.

    You must understand that under law of land, the way happening has been explained to police is serious offence. So work around explanation based on language gap, cultural gap, traditions gaps, etc. to minimize its impact. Show your preparedness to accept bridging of gaps to meet the law of land.

    You have to remember that Schedule A is a one time 50K cap. DOS mentioned that the category will be eliminated from VB soon. They expect to hit the 50K cap by the end of this month and thats why they will not accept any more new applications from then. So who ever were able to sneak in under that category, will get their GC. There will not be a Schedule A category unless congress approves again.

    Unless all of the 10,000 immigrants are going to bring money from their respective countries to buy homes, it is not going to change anything signficantly. You are proposing to take the money that is in the system, i.e asking banks to lend you money. The current crisis is credit crunch. Banks dont have money. All they have is mortgage bonds. There are no takers of these bonds. They are becoming junk. So, if any money from outside flows in, there will be some difference.

    i am in the 3.a. situation. what does part time mean? can you really be working part time when you are a CEO, CFO, COO, CMO of a company? not that i am raising this questions... I want to continue to be in the 3.a. situation, but can the IO ask these questions? if i make revenue of $20000 (twenty thou) and profit of $2000 a year will that be considered enough for IO to think that my intention is to switch to my company after green card and hence no intention of continuing permanent employment? or is that number higher (or lower)...

    I want to become a believer in your 3.a. statement... please let me know what you think.

    From what I can gather, from the immigration perspective:

    1. If you are on H1 - You can technically start a business but since you cannot "work" towards it, in practice it's almost impossible

    2. If you are on H1 and have an EAD - You can start a business. But if you use your EAD, you are no longer on H1. (There are contradicting views on using EAD for PT while still maintaining H1. For now, this is a grey area)

    3. If you are on EAD -
    a. If you plan to work on your business on a part time basis and stay with your sponsored job full time, I don't see a problem with this.
    b. If you plan to work on your business full time, you might have an issue with a RFE at the I-485 stage as you would have used AC21 for self employment (Some people say this is okay, but it depends on your risk taking ability)

    Thoughts?

    Sanju, add78 and FinalGC and others...great points...Thanks for sharing your thoughts. I am in similar boat as the OP. Its just that I already ventured out and now I am working as an independent contractor. I have a layer to go through between the Client and my employer (Desi).

    Big consulting firms could charge 180, 200, even 250 to the client depending on the market rates for the particular skill set. Like most of you all mentioned, they do because like you, they want to make money as well. They have a bigger obligation of making their stakeholders happy. They do lot more than an average independent contractor do. They establish contacts mostly not at the middle manager level, but at the CEO level. As a CEO/CIO of Deloitte/IBM they have better access to CEO/CIO of the client. As it is pretty obvious, CEO/CIOs of the clients actually make/break decisions. So they are generally more successful getting big dollar projects. Once they secure a project, they obviously tend to place their employees on to the projects. Occasionally, they also hire sub-contractors AKA independent consultants when they don’t have enough internal resources.

    I am looking for ways to be a successful independent contractor. I believe, networking and building a reliable set of people who can help you is very important. But the challenge is, it is not easy to find people who are reliable and who will ACTUALLY help you land a project. And of course it is not easy to stay in touch with everyone (at least for me).

    To OP: I think you will have to decide what you want to do in your career. If company sponsored training, marketing, working on cross platforms/applications, stability, "company name on your resume", etc is important, you will have to compromise on the money. If you want to make quick money, take the plunge and jump in to independent consulting. You can potentially double your salary. You don’t have to have a G.C. to be a independent contractor. G.C./EAD certainly helps but not a requirement.Find a good desi employer who will support you and who will pay you "your share of money", find a good stable project and you are good to go. YOu can save money on taxes as well. But then the downside is, you pay for your own training, traveling and benefits.

    End of the day - There are pros and cons on both sides of the world. Pick your choice, you will have to compromise on the cons.

    BTW: I have to agree with Sanju on the commissions/under the table transactions that are reality in the consulting world.

    Although you bring up interesting discussion, but these stories about Neelima are really old. Dec 2005 ?

    Did you see anything recent on her ? Any updates ?

    As for handling these situatsions being diplomatic is best but that is easier said than done.

    Also, I think we are much more likely to face these types of problems with small companies which are in remote areas.

    Big corporations are much much better. I have been lucky in this regards that I have mostly worked with big corps.

    These companies actually go to extra lenghts to appreciate diversity.

    In fact last year in my current client Indians organized big Diwali festival celebrations to
    give American people a chance to enjoy Indian food and learn about our culture.

    Its not all bad. There are some very very good facets as well.

    Theoratically what you say is correct. Once the revised bulletin came out people are not supposed to file / send out mails in this matter. However, what the AILF is going to fight is the "revised bulletin". They are going to fight that uscis cannot publish a revised bulletin at such a short notice and if they (AILF) wins, this revised bulletin is nullified and July will become open to every one with LC, right??

    The more complex patients they deal with, the more they pay on mal practice insurance and other stuff. But I feel that on avg, they make more money than IT people on avg easily. AFAIK, A physician with good experience easily can make 150K-200K. C mon Docs in Residency take home 3K after taxes per month.
