One interesting point that came out of that recent hearing.
PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!

It is a public Forum. It is created for sharing ideas among the members. The success story of mr Reddy will give inspiration to other members to be successful. The Information Technology Association of America (ITAA), a lobbying group representing high-tech companies, says the bill won't do enough to compensate for a shortage of skilled workers and will make it more difficult to hire qualified people from overseas.
In a letter to Senate Majority Leader Harry Reid and Minority Leader Mitch McConnell, ITAA President and CEO, Phillip J Bond, said America's economy is strong and vibrant, but the country's future competitiveness rests on the ability of firms to recruit globally.
"As you know, the H-1B cap for FY '08 was reached in April, shutting out US employers from recruiting highly skilled foreign nationals who are graduating from US institutions with degrees in computer science, engineering, mathematics and other scientific and technical fields.
"Vacancies go unfilled and highly valued workers are forced to leave the country. Even worse, significant shortages exist in the permanent resident visa (green card) programme," Bond said.
Jeff Lande, a senior vice-president at the ITAA said the industry wants more people to be able to come into the country to fill shortages.
"We also want more green cards because for many companies they want someone to come in here who can innovate for their companies work for their companies and who can transition to permanent status," Lande told the National Public Radio.

Spoke with Amit at USINPAC. Looks like the dude doesn't know any thing and might be a summer intern and Mr Robinder Sachdev is in India right now, I asked for his contact info and he doesnt have it right now. He is trying to get his contact information and also escalating with his higher ups. He said that he is receiving a lot of calls from IV members. Dont fire up on this guy. He is just taking calls. I told him that its unfair to grab/steal credit with out mentioning the source and also pointed out how IV has been renamed to Emigration Voice in the original story.
IV should have a own press release refuting their claims, if we do not hear from them in a day or two. That way we can expose them right away and stop them from doing so again in the future. Other wise, this might become a common thing for them

I had all paper work ready for PP and were sent to my Lawyer for premium processing of my Sch. A case. But retrogession occured that night in Nov. visa bulletin. So my lawyer advised me that it is not advantageous to go for it unless your date is current. So we did not filed it.
As I remeber you were not ready for premium process. Any reason or justification for rethinking your decision? let me know if you can outline some advatage of PP of Sch. A at this point, or have seen some cases which enjoyed some advantage due to PP very recently.

I don't think dates will go back again unless they drastically move the dates forward. The dates could remain stagnant for a long time though.

I filed my I485/EAD/AP on August 7, 2007. Does this mean that I do not have to pay any fee for EAD renewal now ?
The instructions say this -
Special Instructions :
If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

It is not over till its over. Anything can happen, we have a lot of things going for us. The present congress wants to show that it is not a 'do nothing' congress. Our items can be a part of any appropriations or other bills. AILA is pushing big time for H1-B1 and EB Relief, so are other vested business interests. This is the last chance they get to get an increase in H1-B1 for this year(They probably are not so much interested in EB-relief), But we can piggyback on most bills dealing with H1-B1 increase, our provisions will be in there.

Most of the folks are missing the point about the prior years approval numbers. All the approvals from 2004 - 2008 are padded with huge visa number from FB spillover and the recapture provision of AC21. From this year onwards we have to live with the usual ~3K per country per category limit. This is the reason why Charles Oppenheim is predicting decade long wait for EB2 I/C and all EB3's. We continue to beat down Oppenheim claim with our own numbers, but he knows more about visa numbers than any one of us.
Let us dream about recapture being a panacea to the problem. There is only limited amount of visa's to be recaptured (~180K) even with that not all categories can become current. Also during that last recapture debates there where lots of suggestions to stagger the usage of recaptured visa over a long time frame like 5 yrs. Even with recapture, the date movement will not be rapid, but it will be remarkably better than what it is now.

My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.

Some Attorneys advise the HR to proactively file for AC21. There is one company (huge) where when you are being offered a job on EAD after AC21 - the HR dept makes a big fuss - asks for all documents like copy if Labor, 140, 485 reciept any any other documents and then makes you sign G 28 and then file for a G28 change in Attorney and associate AC21 docs with those. I guess, the Attorneys charge money so it is a business. If RFE or denial - then more money.
My recomendation is to hire a ethical and realistic lawyer and not a greedy one

If Martin Luther King Jr. can use the views of Gandhi successfully, why bother what we learnt in School?
Has anyone seen the statue of Mahatma Gandhi at the MLK memorial at Atlanta as well as a whole section devoted to Gandhi in the museum.
Huh? I was trying to convey that Gandhi's philosophy of passive resistance was so awesome that it had a strong impact on even a "little" person like me, growing up in Apartheid South Africa. And frankly, nations are made up of more "little" people than heroes ;)
