This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.
As per replies to senator from USCIS

I only see 3 approvals in Oct...
I asked my attorney he said that I need to wait at least 1 more year. The Nov and Dec are gone in holidays. These Gov emp are worst then Indian Gov Emp.

Guys,
Based on the posts here and elsewhere,even I had reached a conclusion that if your PD is not current and if you get married when its retrogressed,you will have to wait till it becomes current to add your spouse to your I-485.
But recently,I was talking to a friend.He was in exact same situation couple of years back and was thinking he cannot add his spouse.But when he contacted his attorney,he/she said there is nothing like that and he went ahead and added her to his 485 without issues. This is fact.As per his attorney any addition to primary application is allowed no matter PD is current or not. The thing is, it went off fine and he has not got his GC yet,but his wife's 485 is also filed.
Now I am not sure whom to believe.Is there any specfic USCIS faq or comments which clarifies this issue?

Ya know what? I am so SICK AND TIRED of our lawmakers bowing down to those illegals, who don't contribute anything to our society. That's right, NOTHING. They steal the jobs that Americans WANT to do, and our lawmakers just bend over and lick their boots!
I married an Indian here on H1-B and it's been two years since we've filed for his greencard. Do you think we've heard anything yet? Only thing we know for sure is that we are getting shafted for following the letter of the law while Elvira (vampire) arellano is sitting up in that pile of crap called a church, with politicians like Barack Obama slobbering all over her. i am getting frustrated to see the bulletin everymonth and it never moves.
people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.
dont know whom to blame. why cant they understand our problems.
r they least bothered.

I am on H4 Visa. Recently i got charged with misdeamener for comming out of store with out paying bill for one of the product. Not arrested and no finger prints taken...just given a slip to attend the court. My attorney advised to attend first time offender program, where after some community service, my case would be dismissed and i need to file for an expungement for trashing all criminal records. Now my question is i have my H4 extension that needs to filed in jan 2012. If my expungement process don't complete before my husband file for h4 extension, will USCIS deport me for having criminal record ?
If there is a possibility for deportation, then i will be leaving to my country then get deported. So that my husband will only file h1B extension and later we both will move to canada at some point as we have PR in canada.
Any advise, will be highly appreciated.

Retain these highly-skilld immigrats that the U.S. needs while American universities train more Americans in the sciences, math and technology that the country does NOT currently have and desperately needs to retain U.S. global leadership and competitiveness"...or something like that

Good idea. lets do it. We need to keep the ball rolling and create awareness among public as well as law makers.
This was discussed before and I cannot find it now..but here is an extension of the degrees idea.
1. Get everyone involved in the GC process to make a copy of their degrees/ qualifications/ certifications/ patents/ papers/ publications/ etc
2. Format it into standard size (perhaps A4)
3. Get a stamp on each of those sheets that says 'TRASH' or something else - maybe 'REVERSE BRAIN DRAIN' or 'KEEP TALENT IN THE US' - we can work that out. - it has to be bold, in RED, if possible across the page.
4. Get each State Chapter to create a binder/ maybe more if we can get enough participation.
5. We can submit a copy of that to local congressman and senators. We can also put all states together and send that to the White House, perhaps.
This will take a lot of coordination from all state chapter...but it is doable.
Any thoughts???

You cannot keep GC out of equation when GC/non-GC decides your ability to get unemployment benefits, choice of jobs and many more aspects of your life.
If you leave the country, you lose the equity on the house. I don't know when you bought
the house. In the post credit bubble period, the lender will make sure you have enough equity that they are secure and you have skin in the game.
Bought my home in early 2008 on 100% financing (yeah, they had these crazy schemes back then!) before the economy tanked. So I havent put down any money. Even the closing costs were paid by the seller. For me its not an investment, but a place to live. So I am not worried about the equity. The home isnt a McMansion and the mortgage payment is manageable. When tax savings at year end are considered, it almost puts me on par with renting.
On the other hand, I dont put GC on a pedestal. I bought my home even before I had started GC process. To me it is not a life changing event like the day I was born or my wedding day or the birth day of my kid. Its something good to have for obvious benefits, but I am not holding my breath until I get it. Once again, I reiter that factoring GC into your decisions is a personal choice, and I dont do it. I am not banking on unemployment benefits or any other govt dole. Like I said, if anything were to go wrong and I had to leave the country for good, my lender will be the one taking the hit. This might not be the case in your situation and I can understand why GC would be so important then.
